Inclusión de la Pena de Cadena Perpetua para Delitos Sexuales en Víctimas Menores de Edad en el COIP

Abstract
La presente investigación tuvo como objetivo general, analizar la factibilidad de incorporar a través de una reforma en el Código Orgánico Integral Penal, la cadena perpetua como pena máxima para el delito de violación sexual a menores de 12 años de edad; dado que, en Ecuador, las cifras de delitos sexuales son realmente alarmantes, pues, según la Fiscalía General del Estado, se recibe alrededor de 42 denuncias al día por este tipo de delitos a nivel nacional; 14 de estas denuncias corresponden a delitos de violación sexual, puntualizando que, de esta cifra, el 21% son cometidos contra menores de 12 años. Por ello, para se aplicó un enfoque cualitativo, aplicando métodos como el analítico-sintético y el inductivo, para procurar la reforma a nuestra ley penal con la incorporación este tipo de pena en el Ecuador, y así, coadyuvar a la erradicación de los delitos sexuales a menores; además de lograr una mayor protección legal frente a quienes vulneran los derechos de los niños.
